The collaboration between the U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (APHIS), the U.S. Department of Justice’s Environment and Natural Resources Division (ENRD), and the USDA Office of the General Counsel (OGC) has reached a significant milestone with the signing of a memorandum of understanding (MOU) on civil judicial enforcement of the Animal Welfare Act (AWA).
Effective as of April, this MOU, signed in March, marks a culmination of nearly four years of close collaboration between the agencies, as highlighted in a recent USDA press release. During this period, joint efforts have led to notable enforcement actions, including the rescue of approximately 150 animals from a Michigan-based animal dealer, some of which were species protected under the Endangered Species Act. Additionally, an injunction was secured to safeguard dogs and cats from mistreatment at a breeding facility.
The MOU outlines a comprehensive strategy to further enhance collaboration and establish a structured framework for notification, consultation, and coordination between the agencies. This framework formalizes procedures for regular meetings, enforcement referrals, information exchange, and employee training, among other key activities. By implementing these procedures, the agencies aim to better prepare for and coordinate civil enforcement actions related to animal welfare.
In a joint statement, the USDA emphasized the shared commitment of both agencies to uphold the humane treatment of animals protected under the AWA. The MOU reflects this commitment and signifies a concerted effort to fulfill their mission of ensuring the welfare of animals under their jurisdiction.
